Rental and Booking Terms

1. General Booking Terms

"The tenant acknowledges that, prior to making a booking, they have read and accepted the general terms and conditions." By booking the vacation home, you agree to the rental terms listed below. Please review them carefully before proceeding with your booking.

These terms apply to the two properties located at 3840 Borgloon, Graethempoort 2 bus 0001 (Palazzio) and Graethempoort 2 bus 0101 (Fruitricht). These conditions can only be altered if the owner has expressly agreed to do so in writing. This written consent will be mentioned in the booking confirmation.

2. Booking

You can book via the website (www.borgraaf.be) or by email (info@borgraaf.be). These methods of booking are binding. By confirming a booking, the general terms and conditions are effective. The person booking is jointly liable for fulfilling the booking steps and rental conditions.

There are no booking fees associated with a booking.

An alternative start date (other than Monday or Friday) is possible, subject to availability and after consultation. Please contact us by email or phone for this.

Booking and payments

Elke boeking wordt door de eigenaar bevestigd door middel van een betalingsverzoek per email.

Binnen de 5 dagen na ontvangst van het betalingsverzoek dient er een voorschot van 50% van de huurprijs + een waarborg van 400 euro betaald te worden. Indien u het voorschot tijdig betaald wordt, is uw boekingsopdracht definitief.

De overige 50% van de huurprijs dient uiterlijk 30 dagen voor de aanvang van de huurperiode te zijn voldaan.

If the deposit and/or the remaining rental amount plus security deposit are not paid on time, the owner has the right to cancel the booking.

In that case, the cancellation terms apply.

The security deposit will always be fully refunded in case of cancellation.

If the rental agreement is concluded within 30 days before the start of the rental, the full rental price must be paid immediately.

The owner's obligation to provide access to the vacation home is postponed until the rental is fully paid.

Cancellation terms

Cancellation by tenant

Cancellations must be communicated by email to the owner, after which you will receive a cancellation confirmation email. The cancellation is only valid upon receiving this confirmation.

If canceled up to 3 months before your stay, no costs will be charged.

If canceled up to 14 days before your stay, the cancellation fee is 50% of the rental amount.

If canceled within 14de days before your stay, the cancellation fee is the full rental price.

The paid security deposit will always be refunded.

Cancellation insurance

Cancellations that qualify for cancellation insurance will be handled in accordance with the insurance conditions of your insurer. We recommend tenants to optionally purchase cancellation insurance from an insurer of their choice.

Cancellation by owner

If unforeseeable circumstances or force majeure force the owner to cancel a confirmed booking, the tenant will be informed immediately and the amounts already paid will be refunded. The tenant has no other right than to reclaim the amount already paid.

Unforeseeable circumstances or force majeure are situations that prevent, make impossible, or complicate the execution of the agreement.

3. Liability

Tenant's liability

The tenant and their co-tenants or visitors must treat the vacation home with the required care and respect, maintaining peace for the surrounding area.

The primary tenant is liable for any damage caused by themselves, co-tenants, or visitors, even if discovered after their departure. If damage is discovered after the primary tenant has left, they must accept the owner's decision.

De vakantiewoning dient als goede huisvader te worden onderhouden. Het is verboden om vochtige doekjes (zelfs geen biologisch afbreekbare!), maandverbanden, inlegkruisjes, tampons, luiers, etensresten,… door te spoelen in de toiletten.  Dit geldt ook voor de keukenafvoer.

The tenant is responsible for closing windows and doors during wind/rain and securing the house when leaving the vacation home.

Any damage must be reported to the owner by the time of departure.

The tenant must ensure that they do not cause noise disturbances. In case of violation, all persons will be removed from the vacation home without warning, and no refund of rental fees will be given.

It is prohibited to use the vacation home for parties, drinking sessions, student parties, bachelor parties, etc. In case of violation, the rental period will be immediately terminated without the tenant having any right to reclaim rental fees.

It is not allowed to make a fire on the terrace/roof terrace.

The vacation home cannot be used as a film or photo location for professional and/or commercial purposes unless written consent has been obtained in advance from the owner.

Smoking: smoking is prohibited in the entire house. Smoke detectors and fire extinguishers have been provided. Smoking is allowed outside the vacation home, but the tenant must always safely dispose of cigarette butts before leaving the vacation home.

The tenant is responsible for theft or damage to the property if theft occurs without signs of break-in. For example, due to not securing windows and doors when absent.

Furniture/decorations may not be moved.

Huisdieren worden niet toegelaten tot de woning. Honden kunnen mogelijk wel verblijven in hondenhotel Pets Paradise, op 1000 meter afstand van ons vakantiehuis. Hiervoor kan je rechtstreeks contact opnemen via www.petsparadisemarleen.be

Indien er aanwijzingen zijn dat deze regel niet nageleefd werd, dan zal de totale waarborg ingehouden worden ten titel van extra kuiskosten. 

During rain and at night, outdoor cushions on the roof terrace (only at Fruitzicht) must be stored in the storage area.

Using a deep fryer, raclette, fondue set, teppanyaki, etc., is prohibited in the house.

In case of loss of the key, a fee of €50 will be charged.

The house rules present in the vacation home form an integral part of the rental agreement and must be strictly adhered to. By signing these general terms and conditions, the tenant(s) confirm that they have read the house rules.

Liability insurance

The tenant is advised to be insured for third-party damage, such as liability insurance (family insurance). The tenant is reminded to ensure their legal liability (e.g., for a fire caused by the tenant/co-tenant in the vacation home) is covered. Please check with your insurance agent.

Owner's liability

The owner is not liable for loss, theft, damage, or injury of any kind to tenants of the vacation home (including the outdoor area).

The prices and costs mentioned on the booking confirmation are applicable.

The owner cannot accept liability for damages caused by natural disasters, nuclear disasters, terrorist attacks, strikes, violence, or collisions with aircraft or its parts.

Construction work may be ongoing near your vacation home (e.g., roadworks). The owner accepts no responsibility for any noise disturbance and does not allow price reductions due to this.

The owner is not always on-site but is reachable by phone.

All booking agreements and related arrangements are governed by Belgian law. Any disputes that cannot be resolved amicably will be submitted to the courts in the Tongeren district.

4. Maximum number of people

The vacation home Palazzio can accommodate up to 9 people, and the vacation home Fruitzicht can accommodate up to 8 people. This number may not be exceeded. If the number of visitors exceeds this, the rental agreement is automatically considered terminated, and access to the vacation home will be denied without any refund of the rental fee.

Children under 2 years old are not considered full persons but must be mentioned in advance.

Exceeding the maximum number of people renders the rental in violation of Flemish regulations on fire safety and the fire insurance, with full responsibility resting on the primary tenant.

In the case of renting a house with less than full occupancy, the maximum number of people is equal to the number mentioned on the booking confirmation. Additional people staying without the owner's knowledge are not permitted.

Subletting is not allowed. If it is discovered that the vacation home is sublet, the rental agreement will be automatically terminated without any refund of rental fees.

5. Arrival and departure

Please respect the arrival and departure times.

Arrival time: The vacation home is available from 16:00 on the arrival day. If your arrival time differs from 16:00, please notify us in advance.

Departure time: every Friday or Monday by 10:00, on Sunday by 17:00.

A longer stay is possible depending on availability and after consultation. A late check-out is also possible, subject to availability and after consultation.

6. Waste sorting

The tenant agrees to sort their waste properly.

Regulatory waste bags are provided.

Household waste, PMD, kitchen waste, glass, paper, and cardboard must be sorted at the designated location in the parking area.

7. End of stay - final Cleaning

The rented vacation home must always be left clean at the end of your stay.

This means that you need to:

  • remove bed linen (including pillowcases), fold it, and place it on the floor next to the bed; the mattress protector should remain on the mattress
  • put everything back in place
  • empty all trash bins
  • clean the counter and place clean dishes in the cupboard
  • empty and clean the fridge and freezer if necessary
  • vacuum the vacation home/sweep it clean
  • clean the barbecue and/or oven (thoroughly clean all grills and the lid; cleaning materials are available in the storage area)

If the house and/or terrace do not meet the above requirements, the owner reserves the right to charge extra cleaning hours at a rate of €30 per hour.

Please turn off all lights and close windows and doors upon departure.

8. Consumption

The rental price includes the costs for normal water and electricity consumption. Excessive consumption will be deducted from the paid security deposit.

9. Internet

There is wireless internet available in the property. The use of the internet during the rental period is entirely the responsibility of the tenant. All internet traffic is logged; illegal downloads are prohibited.

10. Security

For security purposes, cameras are installed at the front door of both vacation homes and at the parking area. Viewing footage in real-time is only permitted for immediate intervention in cases of crime, damage, disturbance, or disruption of public order. Recording footage is only allowed to collect evidence of disturbances or acts that constitute a crime or cause damage, as well as to trace and identify offenders, public order disruptors, witnesses, or victims. If the footage cannot contribute to this, it will not be retained for longer than one month. Only the property owner is the data controller.

11. Deposit

The vacation home contains valuable items, and the deposit of 400 euros is intended to cover potential accidents, damage, or missing movable property.

 Complaints related to existing damage or defects in electrical devices must be reported within four hours of arrival at the vacation home, and should be communicated to the owner.

The vacation home is inspected during cleaning. It is during cleaning that damage, loss, or breakage can be identified. If everything is left in good condition and no damage or breakage is found, your deposit will be refunded by bank transfer no later than two weeks after your stay. If the damage exceeds the amount of the deposit, the tenant is required to make an additional payment within one week of notification.

A dispute over possible damage is a conflict between the owner and the tenant. The owner will decide on the deposit.

It is advisable to report any accidents immediately to the owner. If something breaks, it is recommended to set the broken pieces aside for the owner. This way, they can identify the broken item, which helps avoid discussions and misunderstandings.

It is advisable to communicate with the owner in case of an accident or dispute. This allows matters to be clarified, and a solution that both parties can accept can be reached.

12. Homeowner’s visit

The homeowner is permitted to visit the vacation home in order to check that all obligations are being met. This right must respect the tenant's privacy and be carried out within reasonable limits.

The homeowner is allowed to enter the vacation home for urgent maintenance work on internal installations. This right must also respect the tenant’s privacy.
